Maharally: Help us reach out to the world

Subject: Maharally: Help us reach out to the world

Can you guys also search out international cycling groups/associations and cycling event organisers/participants across the globe and write to them similar short enticing messages, which will make them come and ride with us!(it would be a publicity blitzkrieg, even if 1 foreigner joins us!, besides the pull it will exert on the international media!).
You should especially write to the Dutch cycling embassy, they would then link us and support us everywhere they have a reach to, pls find the relevant emailids at: http://www.dutchcycling.nl/ ,  https://twitter.com/Cycling_Embassy (pls tweet tagging them, etc), http://www.youtube.com/user/DutchCyclingEmbassy and http://www.linkedin.com/groups/Dutch-Cycling-Embassy-3881134?trk=myg_ugrp_ovr

Also contact: http://www.letour.fr/le-tour/2013/us/ (Tour De france the most coveted cycling event, for the Time being!, till Maha Rally picks up pace and popularity, not really joking, it should be our dream... and if we dream right and act meticulously.... it will materialise, it's just a question of when, no whether!). Tour of Nilgiris is our own event : http://www.tourofnilgiris.com/ .

Ccing to some who are closely associated with cycling for their info and references. Pradeep, Vimal, and other cycling pals, please do send us emails/weblinks of organisations and individuals who could be interested in associating with the Maha Rally.
******************************************
Guys, "Maha Rally for Change" is all about positive changes and reforms around each of us, which concerns everyone. Check out MR website: www.maharally.in

Hence we need to reach out to everyone across the globe, to get international support(they could use this new social-movement model, in their own countries, mixing sport with social responsibility, through solution & result-oriented patriotism and positive activism) network with all possible cycling groups nationally and internationally.

We also should inform cycling events worldwide about the Maha Rally and what it stands for, this actually deserves to be made bigger than the Tour de France, though it cannot be compared to any cycling event per se directly, since it's more of a socially responsible yatra, a  journey involving exploration of self and our country, in which one gets a chance to be a real "change-agent", touching various parts of India, trying to tie up the problems across  India, to those(voluntary groups, govt. agencies or individuals) who can work on suitable solutions.

The Maha Rally, is not just sports, it's Karma Yoga: www.maharally.in

A (imperialistically)beautiful mind: Conquer, plunder, set fire and then lament about the sorry state of affairs!

Gist: After killing 100 rats, the cat goes for Haj!!! or "Sau chooha maarke billi haj ko chali!!! (paraphrasing a hindi saying)

Hi All,

These are the same guys(Britishers) who cunningly found a way to demolish the bedrock of Indian supremacy... right back in 1835, Lord Macaulay remarked after travelling extensively across India that to subjugate India completely, britishers need to find ways to demolish our very backbone.... our spiritual and cultural heritage, so that they can replace our superior educational system, culture, values and family system, with English educational system and everything else english!.

And here Sir Winston Churchill is lamenting that India will turn into shambles if they leave India to its own.... after ruthlessly and consciously masterminding a planned and comprehensive anarchy and corruption in this country before hand(Lord Macaulay's above remark was made to the English parliament in 1835, see this link for the original scanned image reporting this(towards the bottom of this link) : http://at498a.blogspot.in/2010/02/economic-terrorism-and-its-family.html)

This is not an attempt to justify our present state of existence, this is just to put things in a better perspective... britishers were imperialistic power-mongers who lived and thrived by plundering nations after subjugating them, who employed all kind of sleight and deceit like the very successful "divide and rule" strategy to further their objectives. In the process they always left/quit the countries they used to rule upon... broken and in shambles, and preferably after creating a permanent source of disruption ... like how they masterminded the Indo-Pak division!, with a clear objective that both these countries they quit should never be able to  prosper as they can run wedges between them for a long long time even after they quit(those who have studied the clever 'wedges' they have driven into our internal structure would realise this very easily).

All Imperialists are just a bit more sophisticated than the barbarian armies of the past, who conquered, plundered and then set fire to lands they conquered, and made sure that they drove a final heart-wrenching 'wedge' into the very psyches of the conquered people, like raping the women of the conquered land, so that the men of the land feel so miserable that even after many many generations they as a society have this trauma fresh in their minds!!!.

We are talking about the same barbarians, now in shiny coats and boots... so take all what they dish out... with a pinch of salt!... if at all u r unable to reject it outright, for what they are really worth.

NB: Don't forget to read http://at498a.blogspot.in/2010/02/economic-terrorism-and-its-family.html to get a perspective of what is the main cause of India's maladies. Then it was the british, now its the USA... very long back it was the Barbarians.... just change of clothes, character is the same!... watch out for these parasites, for good.

regards
Gokul

Subject: Winston Churchill's argument against Independence for India

Churchill predicted about India 66 years ago.. and now the kind of corrupt politicians from the Central to State to the village/city councilmen, and the Govt officers in every level through out the country,
Churchill's prediction came 100% Right.

http://wiki.answers.com/Q/What_did_Winston_Churchill_think_about_India%27s_freedom#page3
Winston Churchill in Parliament for India Independence. When Mr. Clement Attlee, Prime Minister of United Kingdom, in June 1947, introduced the Indian Independence Act in the British Parliament, Sir Winston Churchill, argued against:-

"Power will go to the hands of rascals, rogues, freebooters; all Indian leaders will be of low caliber & men of straw. They will have sweet tongues & silly hearts. They will fight amongst themselves for power & India will be lost in political squabbles. A day would come when even air & water... would be taxed in India.  "

India Vs Pakistan - Pak wins hands down!!!

India Vs Pakistan - Pak wins hands down!!!.. any other country wins for that matter!!!... read on......

Here is Pakistan' s DV(Domestic Violence) act http://www.na. gov.pk/uploads/ documents/ 1300322603_ 188.pdf

Its not biased like ours, our DV act name(Protection of Women! from Domestic Violence act) itself hurriedly denies men's rights!.

Pakistan also has a gender neutral Sexual harassment at work place act (http://www.na. gov.pk/uploads/ documents/ 1302130845_ 543.pdf)

And we say India is more developed than Pakistan!!!

Short excerpt of Paki DV

1. Short title, extent and commencement. - (1) This Act may be called the Domestic Violence (Prevention and Protection) Act, 2009.
(2) It extends to the whole of Pakistan.
(3) It shall come into force at once.

2. Definitions. - (1) In this Act, unless the context otherwise requires,-
(a) "aggrieved person" means any woman, child, man or any vulnerable person who is
or has been in a domestic relationship with the accused and who alleges to have
been subjected to any act of domestic violence by the accused;

All over the world Domestic Violence and Sexual harassment laws are "Gender Neutral", but India happily denies rights of 50% of its citizens by excluding men from the protection of these laws?... ever thought why???.

You need to think, since you could be NEXT!!!

The Maha relay vehicle rally for Men's rights(pan-India)

The Maha relay vehicle rally for Men's rights(pan-India): In conjunction with the National meet for men's rights, Chennai, 2012.

Need riders for The Maha Relay vehicle rally for Men's rights(pan-India): Only a relay format rally would be feasible for most of us, for the ones who are on/planning to be on a sabbatical a ride till delhi is well possible(radial routes to Chennai(where the National meet for Men's rights is going to be conducted this year, mostly on 17th and 18th of November) from their hometowns in various parts of India).

The plan is to conduct the rally from November 8th to 15th, start points being North end of India, South, West and East(and may be others if local centres fall in between these coordinates). The longest route may be from the North End of India(say Delhi or Chandigarh) to Chennai, which will be the longest to cover(2100 & 2424 kms respectively), one can easily do 400-500 Km per day(on bikes, cars can do more but they will have to pace with the bikes since its a rally, not a race!) with planned stops for food/breaks and SIF events/dharnas/press conferences... which means a relay team can reach Chennaii from Delhi or Punjab in max 6 days, but lets keep 1 day for buffer/rest/contingency., so 7 days max to Chennai from any extreme of India).

As of now the following members have shown interest in this relay bike rally for Men's rights:
Name Starting from
1) Gokul.P.R - Thrissur, Kerala
2) Amit Yadav - Delhi
3) Atit Rajpara - Pune
4) Yaksh - Lucknow
5) Suhail - Mumbai
6) Sachit - Delhi
7) D.S.Rao - Kolkata
8) Amol - Pune
9) Aggarwal - Gurgaon

We need to execute this "Maha relay rally for Men's rights(pan-India)" milestone... the media frenzy it could whip up and the resultant public interest would be among last nails in the coffin of misandry in India, so screw it..... lets do it(as goes the title of Richard Branson's .book:http://sharatthakur.com/?p=8).

Need more volunteers who can ride and organise a local group from wherever they plan to start the relay rally from(need not ride the full length till Chennai, since its a relay rally one can ride for how muchever kilometers he is comfortable in joining the rally).

At the end of the rally riders can attend the All India Men's rights National meet, conducted in Chennai this year(venue and other confirmed details will be announced later). We can arrange for the bikes to be transported back to the respective locations too, so do not hesitate, we are all here to make this mega events sizzle, just sign up and the rest ... we will all make it happen.

Let me know on gokul (At) siftimes.com , your responses to the groups/forums may not be noticed all the time, so do send your responses to my emailid too.

IBM illegally fires man for his sexual harassment complaint against woman boss: Bangalore mirror

This man, Anish Vohra, was cash-strapped because of IBM's illegal job termination just because he made a sexual harassment complaint against his woman boss. They did not technically fire him, but he was forced to resign after this woman boss created adverse situations for him at work, all this without recording any misbehaviour or failings on his part, with no notice period complied with, no salary/compensation for not complying with notice period of 90 days, etc.,.

The legal notice sent by Anish to IBM reads six typed A4 sized pages and the sexual harassment part is a section of that. The main allegations are about the woman boss abusing her authority and harassing him mentally, and professionally, systematically over a period of 5 months until he was FORCED TO TENDER HIS RESIGNATION. They did not fire him, rather she created a set of circumstances that left him with no alternative but to quit. Added to this was her unprofessional behavior and choice of language, which by IBM's own standards, was not acceptable at any level.

There was no record of any misbehavior or failings in Anish's work, but the woman boss, fifteen days after confirming Anish's job on Feb 01, 201,1 called him to a meeting with HR and insisted that he goes on a Personal Improvement Plan [PIP] in order to continue in IBM. A PIP is conducted for those resources(employees) who are below the mark in every way possible - this action was in direct contradiction with her rating 2 given to Anish(solid contributor, consistently meets job responsibilities, etc. - IBM description!) in December 2010 (with a personal statement from her that Anish had, in the short time span of 4 months, managed to win the appreciation of senior management) and also confirming Anish's job 15 days in advance of his confirmation date. These events show the lady boss' bias, obvious victimization and abuse of power. 15 days after this meeting with HR, Anish had to resign.

He is now unable to find enough money to treat his ailing son

See the FB page "Pray For Abhijaat"created for raising money for his son's treatment for Cerebral Palsy, to keep him alive  and also the Website for the same .

Former delivery manager at IT firm demands Rs 88 L compensation; the company terms his charges ‘unfounded’ and ‘without merit’

Anish Vohra
Debunking the common stereotype of a male executive hitting on a female colleague, a male mid-level manager has quit his job at IBM, alleging sexual harassment at the workplace. In a first-of-its-kind case, the man has filed a complaint with the company and has also slapped a legal notice on his former “offensive” woman boss and two others, including the MD of the IT behemoth’s India branch.

In the legal notice, Anish Vohra, who worked as a delivery manager for the company, accused his former woman boss of using abusive language while speaking to him in the office. Vohra alleges that he was forced to resign from the company and has claimed a compensation of Rs 87,91,650, including mental torture of Rs 10,000.

Policy at IBM forbids employees from speaking to the media, unless expressly authorised to do so. Hence, the name of the woman boss is being withheld because her version of the events could not be obtained.

Vohra joined as a delivery manager (proposal and ICAP) on August 16 last year and was on six months probation at IBM’s Global Enablement Center. He began working directly under the supervision of the woman he now accuses of harassing him. He claims he was confirmed 15 days ahead of the stipulated six months by which time professional relationship with his boss had already begun to deteriorate.

A paragraph in the legal notice reads: “Our client states that after giving a rating of 2, indicating excellent performance, suddenly she became hostile and beginning in December 2010, the professional relations deteriorated. She started losing patience and became highly critical without any reason and was abusive at times. On account of this behaviour our client (Vohra) sought a meeting which was held on 10.01.2011 and 14.01.2011, wherein she stated, ‘You are different from other managers in IBM. I need to treat you differently from them. I have been unnecessarily harsh with you I agree. I apologise for this behaviour’.

“In the second meeting our client further states that she also uttered the following words, ‘I do not know what it is between you and me I just cannot get along with you’. And also stated, ‘I get the feeling that you are jacking me of and simply f***ing around with me’ and then stated ‘forgive the words/expression used’.
“Our client states that the use of unparliamentary language was in the least objectionable and if uttered to a senior management would have resulted in termination of services.”

The notice goes on to say, “Our client states that at the time of joining service of IBM our client had signed the Business Conduct Guidelines (BCG) which specifically prohibited use of slang language as well as use of profanity or language which would hurt the sentiments of another. Our client states that the language used also amounted to victimisation of our client, for reasons best known to her and which was never disclosed to our client.”

Vohra also claims that the language used by his former boss amounts to sexual harassment as, “IBM being an Ideal Employer, has framed strict rules for prevention of harassment at the work place, called Recognition & Preventing Workplace Harassment- India Employees Edition. Work place harassment is a violation of human rights.”

Vohra has also alleged, “The employment contract stipulated that the company or the employee may terminate the services at any time by giving 90 days notice or salary in lieu thereof. However, without informing me or recording any misbehaviour, they forced me to resign abruptly without paying me any compensation or salary for the notice period.”

The notice was also served on Shankar Annaswamy, managing director, IBM India Private Limited, and Lynette Clunies Ross, director, Sales Transaction Hub, GMU, IBM Limited.

IBM at first refused to answer phone calls or respond to emails from BM seeking their comments. An IBM spokesperson eventually said, “We have fully investigated this matter. The claims made are unfounded and without merit.”

Anish Vohra has set up a community in the social network to raise funds for treatment of 2-yr-old Abhijaat, who suffers from cerebral palsy

Facebook has helped Anish and Deepti raise Rs 1.5 lakh of the Rs 56.35 lakh they need for their son’s treatment
It’s every parent’s worst nightmare, but Anish Vohra keeps his chin up. His two-year-old son, Abhijaat, is suffering from cerebral palsy, and the city-based former IBM delivery manager needs funds — $125,000 (Rs 56.35 lakh) to be exact — if his son is to live a healthy life.

Vohra, who has been unemployed for the past three months, is strapped for cash, having already spent all his savings on Abhijaat’s treatment.

At the end of his tether, he has set up a community on Facebook and has launched a portal in the hope of raising money from donors to fund stem cell treatment — Vohra’s last hope — for his son.

Vohra believes that his Facebook forum, ‘Pray for Abhijaat’, and portal ‘For Abhijaat’ have helped him appeal to a wider audience.

He launched his online campaign last year and has raised $3,348 (Rs 1.5 lakh) so far. He keeps donors updated on Abhijaat’s progress with frequent posts on the sites.

“He came into our lives on July 3, 2008, suddenly, unexpectedly and a good four weeks ahead of schedule due to low amniotic fluid,” Vohra posted. “He did not cry right after birth, he had a breathing difficulty due to very bad stridor (obstruction in the air passage). At first, doctors did not give him a chance, but with the help of C-PAP and oxygen, he survived. He was a good healthy baby, no major issues.”

But Abhijaat was afflicted by a number of complications. He continued to suffer from respiratory problems, his right knee was dislocated at birth and he lacked the ability to grasp things, to sit or to smile, walk or talk.

Abhijaat has been in and out of hospitals and has already had three surgeries, the last in Chicago which cost $197,614 (about Rs 89 lakh).

“We got his knee fixed with physiotherapy and splinting,” Vohra posted. “No one told us there was something wrong with him, just that ‘milestones were delayed’. We used to think ‘So what. He would come around’.”

Vohra and his wife Deeti’s world came crashing down when they learnt from a paediatric neurologist that their son had cerebral palsy.

“His motor abilities and speech have been affected. His hands and legs are spastic.

“Maybe Abhi does not pronounce consonants yet to say Mama, but he makes enough sounds for us to hear Mama in there somewhere. He holds objects placed in his hands for a little while, listens to the sound of our voices and responds to rudimentary instructions.

“He shows us there is the possibility of a good healthy life within his reach. He is the sweetest little boy you can imagine.”
Dr Gyanam, one of the paediatric specialists treating Abhijaat at Manipal Hospital, said, “His brain cells were damaged at the time of delivery because of a lack of oxygen to the brain.

“It will take a while for Abhijaat to be discharged as he now has pneumonia triggered by an infection in his lungs.”

What ails AbhijaatCerebral palsy is a non-progressive, non-contagious motor condition that causes physical disability in human development in various parts of the body. Abhijaat needs stem cell treatment available in only a few countries such as China and Germany. There is no guarantee that the treatment would work. The Vohras are in touch with the Wu Stem Cell Medical Centre in Beijing. They would need boarding and lodging for the duration of the treatment - typically three months. It would cost about $125,000.

Black day for India & Indian families - Anniversary of the anti-family D.V Act

On October 26th(2006), the highly biased and anti-family, anti- human rights, constitutionally ultra vires, Domestic Violence law(PWDVA) came into force in India.

This day was a small step for the anti-india, "anti-family bandwagon", the feminazies, their cronies and their puppet-masters, but a giant leap for Mankind, as we know it, into the abyss of injustice and against all the tenets of natural justice .

If we are even a bit concerned of our children, we need to understand this abysmally retrograde, suicidal, leap of mankind, and act upon our inferences, yes we need to do it like there's no tomorrow, since there won't be a tomorrow this way!

Check out: http://antimisandry.com/a/eroding-faulty-duluth-model-1322.html and
http://www.manwomanmyth.com/domestic-violence/when-is-domestic-violence-not-domestic-violence/

Black day was observed in Bangalore and other parts of India to spread awareness among the unsuspecting Indian citizens. Old aged parents getting kicked out and dispossessed of their own hard-earned houses, un-involved relatives reined in and harassed for years together, whether they be male or female.

These traits of this law are enough for any common man to understand that this law is not pro-Women or intended for women-protection at all, this law(PWDVA) is just a "weapon of mass destruction" in the hands of unscrupulous people, and vested powers let this injustice continue, since India can only be weakened by weakening and obliterating its family system!

Root cause of Indian systemic-rot - Abysmal leadership quality

Original article at->   Know the root cause of all problems in India-lets facilitate quality leadership everywhere and solutions will follow

Crime or criminality is not a monopoly of any class or  gender, nor does crime have a class or gender factor. This is true for goodness or badness too.

The current problem in India is that, since judiciary , law enforcement and the the whole system consisting of the government/authorities in general are all corrupt and our quality of leadership is abysmal.

Hence the Corrupt, Rich and powerful get what they want by hook(undue favours from government schemes meant for public welfare!) or crook(protective provisions/laws intended for protecting the weak(if you search around the internet you will find that the protective provisions for SC/STs , Women have been misused widely and has been acknowledged in the official circles too, for example misuse of dowry laws are termed as "Legal Terrorism" by the Supreme Court of India itself!) and poor are misused by the corrupt, rich and powerful people)

And its a fact that unfettered/absolute power corrupts, and in India women-protection laws give that unfettered power to only the women who misuses it(with an intention to get undue power of negotiation, to wreck vengeance, etc.,.)

***So the genuine victims among men or women do not have any support from the present set of laws or provisions/schemes by the government***, since all these facilities and laws are misused with oblique motives by the corrupt, rich and powerful(irrespective of their gender!)!!!.

The solution is simple(albeit tough), all citizens(including all victimised men and women) join forces and bring a new order in society and make a system which only promotes good leaders and eventually purge the bad leaders.

These good leaders will eventually set right the implementation of laws and schemes intended for public welfare(which are presently misused) and ensure that the support/relief goes only to the intended and deserving victims/beneficiaries, since they would be responsive to the people who elected them and be efficient and capable to undertake the massive systemic correction we would have to do, to set right and prevent the re-emergence of the systemic-rot, that we are in presently.

It is with this Idea that the Great India group was formed(Facebook group for Great India: http://groups.to/gi) .
Do visit and join after reading the links and posts there. Also Download the ebook - Great India..Indian Democracy: Problems and Solutions-> http://bit.ly/bmnTkY  This would give the readers an idea of what has been thought of by the Great India group, please do join and contribute to the work-force of patriots who have already pledged their support in Great India's action plans

Together we can do whatever we intend to do, to bring about the changes we want around us.

Let us be the part of the solution, and not part of the problem(by just cribbing/complaining about what we do not like around us), lets be the change-agents ourselves, because we can do this together.... the road ahead is tough but NOT AT ALL IMPOSSIBLE to traverse, can we do it, if we are united..... do join us and contribute your efforts along with us, see you at Great India facebook group: http://www.facebook.com/group.php?gid=117237851655573 or short url http://groups.to/gi .

National Litigant Bench(NLB) launch: Press release, August 15, 2010

Press Release
Sub: AlMWA attending 3rd National Conference of Family Rights Organizations
in Yercaud & Launching NATIONAL LITIGANT BENCH (NLB) on 15 Aug 2010.

All India Men’s Welfare Association (AIMWA) is an organization whose main objectives are:
  • To connect with men and boys across India and understand their needs and concerns.
  • To address issues concerning men and boys, with the specific objective of providing them protection against gender discrimination, domestic violence, emotional castration, negative stereotyping, sexual harassment, legal terrorism and every other form of abuse.
  • To build a powerful broad based lobby for the welfare of men and boys.
Since its inception on 11 October 2009, AIMWA has been working towards providing protection for men and boys against gender discrimination, domestic violence, sexual harassment and other forms of abuse. The organization has also been working on related issues like physical and mental health of men, and the need for social changes, policy reforms and legal solutions to men’s problems.
Members of AIMWA are attending the 3rd National Conference of Family Rights Organizations in Yercaud to present our research and analysis on issues related to men within and outside the family, to discuss our ongoing work, and to point out future directions for NGOs working in the areas of men’s health and welfare.
On the occasion of Independence Day 2010, members of AIMWA are launching the NATIONAL LITIGANT BENCH – a self-help group comprising citizens fighting for freedom from delays, corruption, maladministration, injustice and lack of accountability in the Indian judicial system.
Although India attained freedom from British rule in 1947, the Indian judicial system wreaks of imperialism, corruption and anti-citizen attitudes of the British times, due to which a common man considers entering an Indian court as the worst misfortune of his life.
While the worst sufferers of the Indian judicial system are men, judicial delays, corruption and maladministration have also taken a big toll on women, children and families.
During its many encounters with litigants all over the country, AIMWA found that citizens of India have lost faith in our dysfunctional judicial system as it encourages hardened criminals to commit crime in broad daylight, penalizes law-abiding citizens, and turns ordinary men into criminals.
The National Litigant Bench (NLB) is the first forum of its kind calling for litigants across the country to come together and collectively fight for freedom from judicial delays, corruption, maladministration, injustice and lack of accountability.
On the occasion of Independence Day 2010, we are launching three All India Helplines: 9704683163, 9840324551 and 9620439797. We will introduce more helplines and local chapters in the near future.
We invite all citizens who share our vision of a corruption-free, people friendly, accountable, speedy justice system to join us in our efforts.

Bending it like Shinde!

A Fraud Called
"Divorce on the grounds of Irretrievable Breakdown of Marriage"

People who have seen the news coverage on Cabinet approval of adding 'irretrievable breakdown of marriage' as a ground for divorce in Hindu Marriage Act, 1955 and Special Marriage Act, 1954 are a confused lot. What does it mean? When can a person file a petition for divorce on this ground? How can relief be sought? These are some of the questions I have been searching the answers for.

Legally speaking, “irretrievable breakdown of marriage” is defined as: “The situation that exists when either or both spouses are no longer able or willing to live with each other, thereby destroying their husband and wife relationship with no hope of resumption of spousal duties.”

In this direction, the Law Commission, in its Seventy First Report which was submitted in April, 1978, strongly recommended to introduce irretrievable breakdown of marriage as a ground for divorce. This was in addition to the already available grounds of divorce - ground of fault and mutual consent. The wisdom behind such an amendment, as contemplated was, when a party to the marriage is not at fault, falling in the subsection, nor staying together and further frustrating the other party's efforts to come to a mutual agreeable terms to end the marriage, a divorce on this ground can be sought. The said report recommended detailed guidelines by way of introduction of sections 13 (C), 13 (D), 13 (E) in the Hindu Marriage Act, 1955 and necessary amendments in section 21 (A) and 23 as well. The idea behind the same was that once a divorce is sought on the grounds of irretrievable breakdown of marriage, other conditions like fault of one party be regarded as irrelevant.

In 1981, a Bill was introduced to give effect to irretrievable breakdown of marriage as a ground for divorce, but the legislature in its wisdom did not accept the same, as it was apprehended that unscrupulous people, mainly husbands would desert their wives and take advantage of this provision. A point to be noted here is that section 13 (D) and 13 (E) as contemplated by Law Commission made it clear that a wife can oppose such a petition on the ground that it would result in financial hardship for her, and it made it binding on the court to see that adequate arrangement for welfare of children and wife be made while a decree of divorce be granted on this ground. Despite the same the legislature did not find fit to accept the report and the same was rejected.

The social fabric of India has undergone a lot of changes during the last Thirty Two years. And from time to time the courts have refused to grant divorce on this ground in the cases of Asha v. Krishna Lal (1990 Del.1), Smita Dilip Rane v. Dilip Dattaram Rane (AIR1990 Bom.84), Suresh Prasad Sharma v. Rambai Sharma [1 (1999) DMC311(MP)]. On the contrary, the apex court has dissolved the marriage on this ground in V. Bhagat v. D v. Bhagat (AIR1994 SC710),  Chandralekha Trivedi v. S.P. Trivedi [(1993) 4 SCC 232], Naveen Kohli v. Neelu Kohli [2006(3) SCALE 252]. The case of Naveen Kohli Vs Neelu Kohli is of great importance because by way of this Judgement, the Hon'ble Supreme Court had recommended an amendment in the Hindu Marriage Act, 1955 stating that there can be a great number of cases, where the marriage is virtually dead but parties can not seek divorce on the ground of irretrievable breakdown of marriage as such a ground does not exist in Hindu Marriage Act.

As in the case of recommendation of Law Commission of 1978, this suggestion also fell on deaf ears and despite Law Commission again recommending the same in it's 217th report in March 2009, no progress took place until recently.

It all changed on Dec. 16, 2009, when Smriti Shinde, the daughter of indomitable Union Power Minister Sushil Kumat Shinde, challanged the existing grounds of divorce in Hindu Marriage Act, 1955 by way of Writ Petition. Brief facts leading to this writ are that she had filed a case along with her husband for dissolving their marriage by way of mutual consent in May 2007 and was granted divorce even when the husband never turned up before the trial court. The Bombay High Court set the same decree aside holding that non-appearance of the husband showed that his consent did not continue. The Supreme Court also held the same view and dismissed her appeal. A news report published in newspapers on the next day stated that another powerful political face Supriya Sule was also present at the time of filing this petition, which can be construed as the support of Agriculture Minister Sharad Pawar in the same.

Cut to present, barely a year after the Government of India deciding against the recommendation of 217th report of Law Commission, the cabinet has given nod to the changes in provisions in Hindu Marriage Act, 1955. The way in which the same would be implemented is still not sure, but what Information and Broadcasting Minister Ambika Soni stated to the media about this law raises some questions, the verbatim quote as printed in media states, “This would provide safeguards to parties who file petitions for grant of divorce by mutual consent but who wilfully avoid coming to court thus causing harassment to the other party."

I am a layman, but I have gone through the Seventy First Report as well as Two Hundred and Seventeenth Report of Law Commission. Both reports don't find mention of such pre-condition as parties filing petition for grant of divorce by mutual consent but who wilfully avoid coming to court.
The statement coupled with other facts makes me question the very genuineness of such an amendment.

1. What was the hurry to implement the recommendation of making "Irretrievable Breakdown of Marriage" as ground of divorce, when the same government had not heeded to the same in recent past.
2. Is the government trying to play foul by playing with the recommendations of Law Commission and adding irrelevant conditions to it because such a condition fits in Smriti Shinde’s case?
3. If such irrelevant conditions are added, it would only benefit unscrupulous, powerful and mighty, who can obtain first consent by way of fraud or coercion. One should not forget that the legislature in its wisdom while adding section 13(B) in Hindu Marriage Act, 1955, made a provision that consent can be withdrawn after filing first motion. And for the same a statutory cool-off period of six months was given. If, such a pre-condition is added to irretrievable breakdown of marriage ground, it would defeat the section 13(B) of Hindu Marriage Act, 1955.
